Acceptable Use Policy
Last updated
1. The principle
PayNudge exists to help businesses ask, politely and persistently, to be paid for work they have actually done. Every message sent through PayNudge goes out under your name and affects our ability to deliver email for every other customer. This policy forms part of our Terms of Service.
2. Genuine invoices only
- Only contact people about real, undisputed or genuinely owed amounts arising from goods or services you supplied.
- Do not add invoices you know to be inflated, already paid, fabricated, or owed to someone else (unless you are authorised to collect for that business, such as a Studio brand you operate).
- Only contact the client and the people responsible for paying the invoice, at addresses they gave you or that are published for that purpose.
- When a client disputes an invoice, stop automated reminders and deal with the dispute directly.
3. No harassment or threatening language
You must not use PayNudge to send messages that:
- harass, abuse, intimidate or shame anyone, or contact them with unreasonable frequency;
- threaten violence, criminal prosecution, arrest, public exposure, or action you do not intend or are not entitled to take;
- contact or threaten to contact the debtor's family, employer, customers or other third parties about the debt;
- falsely claim to come from a court, a law firm, a debt collection agency or a government body;
- misrepresent the amount owed, interest, fees or the legal consequences of non-payment.
4. Business-to-business use, and consumer debts
PayNudge is designed for invoices between businesses. Statutory late-payment interest under the UK Late Payment of Commercial Debts (Interest) Act 1998 and EU Directive 2011/7/EU applies only to commercial transactions, and you must not claim it from consumers.
If you contact individuals about personal debts, you are solely responsible for complying with consumer protection and debt collection laws, including the US Fair Debt Collection Practices Act and state equivalents, the UK Financial Conduct Authority's rules (including the Consumer Credit sourcebook) and the Consumer Protection from Unfair Trading Regulations, and similar laws elsewhere. You must not use PayNudge for regulated debt collection activity that requires a licence or authorisation you do not hold.
5. Legal letters and statutory notices
- Only send a statutory interest notice where you believe in good faith that the statutory scheme applies to the invoice.
- Only send a letter before action if you are genuinely prepared to take the step it describes.
- Do not edit drafts to impersonate a solicitor or to imitate court documents.
- Review every legal draft carefully and take legal advice where appropriate. See our Legal Disclaimer.
6. No spam
- Do not send marketing, newsletters, cold outreach or any message unrelated to an invoice you issued.
- Do not import purchased, scraped or rented lists of contacts.
- Do not attempt to bypass sending limits, business-hours rules or the minimum gap between reminders.
7. Protecting the platform
- No malware, phishing links or deceptive attachments.
- No attempts to access other workspaces, probe or disrupt our systems, or circumvent plan limits, except good-faith security research as described on our Security page.
- No automated scraping of the Service or reselling of access.
- No uploading of unlawful content, or content you have no right to use.
8. Enforcement and reporting
We may review flagged activity, pause sending, remove content, or suspend or close accounts that break this policy, in line with our Terms. If you received a message through PayNudge that you believe breaks this policy, please email support@paynudge.site with a copy of the message. We take every report seriously.
